. The learned counsel for the petitioner submits
that the petitioner would make a fresh representation to the
respondent / competent authority to consider his case in light of the G.R. Dated 15.5.1996 issued by High and Technical Education Department of Government of Maharashtra. This is particularly in the back-drop that the case of the petitioner was considered and rejected on the basis of earlier G.R. Dated 7.6.1980 and if at all the petitioner wants to take benefit of the subsequent G.R., it will be proper on his part to move the appropriate authority by way of representation. We, therefore, permit the petitioner to withdraw the petition with liberty to make a fresh representation as observed in our order. In case the petitioner files such a representation before the competent authority within four weeks from the date of passing of this order, the competent authority will take decision within 12 weeks from the receipt of the order and communicate its order to the petitioner after giving a fair opportunity of hearing.
