. Heard learned counsel for the parties. We

have	gone	through	the affidavit	in	reply	of		acting
municipal	secretary.		The	respo	ndents	have		taken
specific	stand	that	in so	far	a	s petit	ioner	is
concerned	he	is at	sr. no.	9	in	seniority	list	of
committee	clerk.	This	fact is	not	dispu	ted.	We	make
it clear	that as	and	when there	will	be	vacancy	an	d if
the	petitioner	falls	within z	one	of	consider	ation	the
respondents	are	bound	to	consi	der	the	case	of
petitioner	for	such	promotion in	a	ccordan	ce with		the
general	body	resolution	no. 462.		In	view	of	this
learned	counsel	for	the	peti	tioiner	subm	it	that
petitioiner	may	be	permitted	to	withd	raw the		petition
with lib	erty to	agitate	issue if	th	e	petitioner	is	not
