. This is Appeal by the Revenue agaisnt the
order of ITAT dated 1st June, 2004 in respect of
assessment year 1998-99. The Tribunal followed its
own order dated 21st March, 2003 for the assessment
year 1995-96 to 1997-98 in W.T.A. No.209 to
211/Mum/02. The Revenue had preferred Appeal before
this Court for the assessment year 1995-96, 1996-97,
1997-98 and by order dated February 13, 2008 in
Notice of Motion No.235 of 2004 in Wealth Tax Appeal
Lodging No.54 of 2004 and other connected Appeals
and Motions we had dismissed the Appeals preferred
by the Revenue for the reasons set out therein.
2. For the very same reasons as given while

disposing of Wealth Tax Appeal Lodging No.54 of 2004
and other connected Appeals vide order dated
February 13, 2008 the present Appeal and also Motion
stand dismissed.
