against acquittal of the accused under section
302 of IPC.. It is stated at the bar by the
learned APP that as the respondent was
convicted u/s 304, Part-II and sentenced to
five years imprisonment, he has also filed an
appeal against the conviction and sentence
being Appeal No.334 of 2008.
2. Since the judgement impugned in this appeal
is also impugned by the respondent in appeal
against conviction, therefore, it will be

necessary to hear both the appeals together.
3. Admit.
4. Appeal No.334 of 2008 shall be listed along
with this appeal for final hearing.
