Heard Mrs. Mandilik appearing for the petitioner and
Mr Rane, Government Pleader for the respondent Nos. 1,2 and 4. The petitioner is an elected Municipal Councillor. He has to get his caste claim decided to be belonging to reserve category within three months from the date of the election, which date expires on 20.2.2007. The caste claim is pending before the Caste Scrutiny Committee. Mr. Rane, Government Pleader has tendered a letter dated 8.2.2007 from the Joint Commissioner for the Scheduled Tribe Caste Certificate Committee stating that the petitioner's claim will be decided on or before 28th February 2007. In view thereof the petition stands disposed of.
In the meanwhile the petitioner will not be disqualified. In the event of order of the Scrutiny Committee goes against the
petitioner, same will not be acted upon for a period of four weeks from the date of it's communication to the petitioner.
Petition is disposed of.
