cheque No.69545 for an amount of Rs.1,00,000/- drawn
in his favour was dishonoured and, therefore, he filed
a complaint under Section 138 of the Negotiable
Instruments Act, 1881, the present respondent no.1
filed a private complaint as a counter blast and only
to defeat the complaint which is filed by the
petitioner under Section 138 of the Negotiable
Instruments Act, 1881. These are the matters which
will have to be gone through by the learned JMFC while
considering the record as directed by the Sessions
Court vide the impugned order dated 5/1/2004. Whether
to issue the process or to dismiss the complaint is an
issue which the learned JMFC will have to consider
afresh on perusal of the record as available before
him and, therefore, no interference is called for in
the view taken by the revision court. Undoubtedly,
the petitioner also will have to be heard when the
learned Magistrate has been directed to reconsider the
record of the case and passe the appropriate order
according to the law.
