1. This petition is filed against the order
dated 6th February, 2007 passed by the District
Judge, Pune in Miscellaneous Civil Appeal No.292 of
2005.
2. During the course of argument, learned
counsel for both sides stated that the suit itself
is fixed for recording evidence on 12th December,
2007.
3. In this view of the matter, without
expressing any opinion on merits of the case, I am
of the opinion that it would be just and proper to
direct the Trial Court to dispose of the suit
expeditiously.
4. Accordingly, the petition is disposed of by
directing the Trial Court to dispose of the Regular
Civil Suit No.156 of 2005 as expeditiously as
possible and preferably within a period of three
months from today. There shall be no order as to
costs.
