1.Rule. Rule returnable and heard forthwith.
2.It is agreed between the parties that the
total amount due and payable by the Petitioner to the
Respondent to date is Rs.38,400/-.
3.Mr.Joshi, the learned counsel appearing on
behalf of the Petitioner states that an amount of
Rs.12,800/- shall be paid on or before 15.11.1007 and
that the balance amount shall be paid on or before
31.12.2007.
4.In the event of the Petitioner failing to pay
the above amounts or any part thereof, the Respondent
: 2 :
is always at liberty to adopt appropriate proceedings
for recovery thereof. Needless to add that in the
event of the Petitioner making the above payments, the
execution application shall stand discharged.
5.The arrest warrant shall not be given effect
till 30.11.2007. In the event of the first amount of
Rs.12,800/- being paid, the arrest warrant shall stand
discharged.
6.In view of above, no further orders are
called for.
The Writ Petition is accordingly disposed of.
