Mr Rajure, learned counsel for the
applicants/appellants, submits that the
applicants would be satisfied if it is
observed that the construction, if any, is
made on the suit property, it would be
subject to outcome of the Appeals. Mrs
Badadare, learned counsel for the
respondent, has no objection for making such
observation. In the circumstances, the
civil applications are disposed of by the
following order:-
Pending hearing and final disposal of
the second appeals, if the
appellicants/appellants make any
construction either themselves or through
any other person or agency, it would be
subject to outcome of the appeals and they
shall not claim equities.
