1. This is a petition impugning
an order passed by the JMFC,
Sangli, rejecting the
application filed by the accused
to shut out evidence of the
witness who was not cited as a
witness in the Complaint. It
appears that certain additional
documents were produced by the
Complainant after his evidence
was over and the production was
permitted by the Court.
Needless to say that the
documents would be used in the
trial against the accused if the
: 2 :
same will be proved. In the
circumstances, Complainant
sought to prove the documents by
additional evidence. This was
sought to be shut out. Merely
because witness is not cited in
the Complaint, that cannot
itself be fatal error. In the
circumstances, as opportunity to
be given to the Complainant to
prove his case, I am not
inclined to entertain this
petition and the same is
rejected.
