1. The impugned Judgment and Award under

section 18 of the Land Acquisition Act,

1894 has been passed on 13th September
2004. Enhancement granted in market value
is only Rs.14,175/- along with interest at
the rate of 9% p.a. for the period of one
year from the date of Award and thereafter
interest at the rate of 15% p.a. till the
realisation of the amount. In this view
of the involvement of small amount and
peculiar facts of the case, Civil
Application is disposed of by passing the
following order :

. Time of two weeks is granted to the
Applicant to deposit entire decretal
amount with the Reference Court. If the
amount is deposited, the Reference Court
will permit the original claimant to
withdraw the same on filing undertaking to
bring back the amount with appropriate
rate of interest in case the Applicant

succeeds in the Appeal.
