grant of bail which has been
preferred in view of liberty
granted by this Court vide order
dated 20.9.2005. Liberty to
file a fresh application for
bail if the appeal was not
disposed of within six months
was granted by the said order.
The appeal has already been
admitted on merits. The
applicant was on bail during the
trial. There is no allegation
of abusing of bail. Looking to
the fact that the sentence is
only of 4 years and the appeal

has been admitted on merits as
also taking into consideration
the fact that specific liberty
was given, I am inclined to
grant bail to the applicant.
Therefore, it is directed that
pending the hearing and final
disposal of the appeal,
applicant may be released on the
same bail as in the trial Court
subject to his furnishing fresh
bond.
