1. After hearing the matter for some time, the
learned counsel for the petitioner seeks permission to
withdraw this petition with liberty to file a revision
under section 154 of the M.C.S. Act, 1960.
2. The learned counsel for the petitioner states
that certain payments have been made towards the dues
certified as recoverable under the recovery
certificate dated 28.12.2001. This fact is disputed
by the learned counsel for the Respondent No.2. If
such payments are made towards the dues under the
aforesaid recovery certificate, the revisional
authority shall consider adjustment of said payments

towards 50% of the recoverable dues which are liable
to be deposited under section 154 (2A) in accordance
with law.
3. All contentions on merits are left open.
