Appeal filed by the present
applicant is admitted. This is his
application for bail. Applicant is
original accused 3 in Sessions Case
No. 2770 of 2002 which was disposed
of by the additional Sessions Judge,
Kalyan on 20/11/04. The applicant
along with other accused has been
sentenced to life imprisonment.
2. The case of the prosecution is
that applicant dealt a sword blow on
the head of the deceased. There are

three eye-witnesses to the incident in
question.
3. Admittedly application made by
accused 2,4,5 & 6 has been withdrawn.
The allegation against them is that
they had given stick blows on the
deceased. We are of the opinion that
the applicant does not deserve to be
released on bail. Hence prayer for
bail is rejected.
4. In the circumstances of the
case, the applicant is permitted to
prepare paper book of the appeal and
move the court for early date of
hearing.
