 1. Heard counsel for the parties. Perused the
 record. Having regard to seriousness of the offence,
 which is in respect of Employment Guarantee Scheme
 promoted by the State, resulting in misappropriation
 to the extent of Rs.50 lakh and as the record
 indicates that the Applicant was working as
 Agricultural Officer,Phaltan between 24-2-1999 to
 14-7-2004 and 12 demand forms issued under the
 signature of the Applicant during period between June
 and July, 2004, not a case for anticipatory bail.

 2. This application is, therefore, rejected.
 However, the Applicant is granted limited protection
 for the purpose of surrendering before the
 appropriate court and to apply for regular bail.
 That be done on or before 8th April, 2005. Failing
 which it will be open to the Investigating Officer to
 proceed against the Applicant in accordance with law.

 3. The Applicant shall give advance notice to the

 concerned Investigating Officer about the date and
 time when he proposes to surrender before the
 appropriate court and apply for regular bail. Order
 accordingly.
