Having		heard	the	learned	senio	r co	unsel f	or	the
appellant	and	the		learned	counsel	for	the		first
respondent,	we		are	satisfied	that	save	and		except

the clarification that we make, no interference is

called for in the impugned order.

2.	The clar	ification	that	we make	is	that	the	order
dated	16.4.2003	and	the	further	order	dated		5.8.2004
passed	by	the	learned	Industrial	Trib	unal	shall	not

be construed to cover the period from 2nd August,

2002 to 15th April, 2003.

We do not deem it necessary to deal with the

other	contentions	raised by	the		learned	senior
counsel	as	those contentions	shall	be	considered	by

the learned Judge while hearing the writ petiton

since the rule has already been issued therein.

With the aforesaid clarification, the appeal is

disposed of.
