. Heard Counsel for the parties. I find no reason
to entertain this application having regard to the fact
situation of the present case. After the dictation of
the order was commenced, Counsel for the applicant
states that the applicant be permitted to withdraw this
application as any observation made by this Court on
merits of the contentions will influence the decision in
the trail pending before the Court below. The request
for withdrawal of the application made on behalf of the
application is resisted by the Public Prosecutor.
However, in the fitness of things, I am inclined to
accept the request of the applicant for permission to
withdraw this application unconditionally. Since the
applicant has chosen to withdraw the application, I
refrain from making any observation with regard to the
merits of the grievance made in this application as well
as across the bar by the Counsel for the applicant.
