investigation file on 30.03.2017 by the issuing authority i.e. Shri Praving Pawar, IPS, then Joint Director, Panaji Zonal Office before issuance of the Provisional Attachment Order dated 30.03.2017. It is further submitted that the counsel for the Directorate is not privy to the investigation files and for that reasons it may have been submitted that any reasons to believe are incorporated in the PAO only the served to the parties and fare not incorporated in file before passing of PAO. It is submitted and clarified further that that the reasons to believe were not only on the file but are always incorporated in the PAO and it is clarified that in this matter, as well, the reasons to believe for attaching the properties as per section 5(1) were incorporated in the Provisional Attachment Order dated 30.03.2017 which was served upon the appellants immediately after passing of PAO and the Directorate can produce the file again, if desired. It is also respectfully submitted that Original Complaint bearing no. 756/2017 was filed before the Ld Adjudicating Authority for confirmation of the Provisional Attachment Order 30.03.2017 to 27.04.2017.”
