The order in the above said appeal was reserved on 21st May, 2019. The one week time was granted to the respondent to file the written synopsis. The judgment was almost ready. However, it was found that the written synopsis was not filed by the respondent. The matter was therefore listed on 07th June, 2019, still the written synopsis were not filed. Thereafter, the matter was adjourned to 05th July, 2019 when Mr. Atul Tripathi, learned counsel appearing on behalf of the respondent seeks more time to file the

written synopsis. Three weeks time was granted and matter was adjourned to 23rd August, 2019. Even after passing three weeks when the matter was taken up today, some more time is sought by Mr. Atul Tripathi, counsel for the respondent mainly on the reason that I.O. has been changed. The request is strongly opposed by learned counsel for the appellant.
It appears from the record for the first time on 28th February, 2018, the opportunity was granted to the respondent to file the submission more than one year and five months have been passed, no written submission has been filed by the respondent. Therefore, I am inclined to pass the order as per the pleading and material available on record.
