Yesterday vide order dated 25.07.2019 of this Bench, I had passed an order where the ROA application was to be taken up for hearing today and both the counsel for the appellant as well as for the respondent were present and the same was pronounced in the open court.
No one appears on behalf of the appellant today. This is an appeal of the year 2002. The learned counsel for the appellant have been delaying hearings on one pretext or the other. Since the appeal has already been dismissed and there is no restoration order as on date and the appellant has chosen not to appear, I think it is a fit case for dismissal for
