Fresh appeal has been filed under Section 26 of the Prevention of Money Laundering Act, 2002 against the order dated 16^th March, 2018. Along with the appeal, an application for condonation of delay of 82 days has also been filed. Mr. Atul Tripathi, learned counsel for the respondent opposes the prayer in the application.

As a matter of fact, the ECIR in the present case was registered on 09.04.2013. The Provisional Attachment Order was passed on 29^th September, 2017 i.e. more than expiry of four years. Learned counsel for the respondent states that the investigation was on during these years.

For the reasons stated in the application along with the medical documents of the appellant produced by the appellant’s counsel, the delay in filing the appeal is condoned.

Issue notice in the appeal as well as in the stay application. Reply be filed within six weeks with an advance copy to the learned counsel for the appellant who may file the rejoinder within four weeks thereafter.
