The counsel for the appellant referred the Judgment dated 14.07.2017 passed by this Tribunal in the case of State Bank of India Vs. The Joint Director, Directorate of Enforcement, Kolkata. In view of the facts and issues involved in this appeal and after taking into consideration the material on record and judgment of this tribunal in State Bank of India (Supra) case we are inclined to allow the appeal.
