A fresh appeal has been filed against the impugned order dt. 28^th December, 2017. It is stated by the learned counsel for the appellant that the copy of the order was received on 9.01.2018. It is also stated that the judgment rendered by this tribunal on 14.07.2017 in the case of State Bank of India was relied upon by the Bank before the Adjudicating Authority however, according to him, the Adjudicating Authority says that the said judgment is not binding.

It is pertaining to mention that in the said judgment of this Tribunal has referred various judgments of the Hon’ble Supreme Court of India as well as order passed by the Hon’ble High Court. The said submission of the learned counsel for the appellant will be dealt with at the time of disposal of the appeal.

Issue notice of the appeal as well as the stay application. Mr. Mohd. Faraz, Advocate accepts the notice and seeks time to file the replies.
