The appeal was filed against the order dated 30.12.2015 which is pending for the last more than 2 years. No notice under Section 8(4) was issued earlier after passing the impugned order. The matter is already kept for final hearing on 27^th September, 2018. However, now the notice under Section 8(4) has been issued. We have gone through the notice which is filed as “Annexure-A”.

As far as Property Nos. 1, 4 & 6 are concerned, these are residential properties. Learned counsel for the appellant submits that the other properties that are mentioned in Serial Nos. 2, 3 & 5 are concerned, let the respondent take the possession (without prejudice) till final outcome of the appellant.

In view of the reasons explained in the application, the „ status quo’ shall be maintained by both the parties with regard to the property nos. 1, 4 & 6 till the next date of hearing. In the meanwhile, the respondent is granted liberty to file the reply by the next date.

List on 27^th September, 2018 the date already fixed for hearing.

The appellant will also file the affidavit disclosing the actual position of the property.
