The learned counsel for the appellant in order to clarify the statement made by the learned counsel for the respondent on 21.2.2018 has informed that no doubt the order was passed by the Tribunal on 12.7.2005 for deposit of 20% of the penalty, the said order was challenged by the appellant in the Hon’ble HC of Bombay by filing the WP by order dated 22.3.2007 which was allowed by the DB of Bombay High Court by set aside the order dated 22.3.2007. Under these circumstances, the order dated 21.2.2018 is clarified. List the appeal on 16.11.2018. Both the parties are allowed to file written arguments.
