A fresh appeal has been filed under Section 26 of the Prevention of Money Laundering Act, 2002 challenging the order dated 19^th April, 2017 passed in O.C. No. 670/2016 by Adjudicating Authority in the Provisional Attachment Order No. 10/2016 dated 16^th April, 2017. The Learned Counsel for the Appellant seeks liberty to delete the Respondent No. 2 from the array of the parties. Order is passed accordingly. Amended Memo of parties be filed within two weeks.

Issue notice. Mr. N. K. Matta, Learned Counsel for the respondent accepts the notice and he seeks time to file the reply. Let the same be filed within six weeks with an advance copy to the Learned Counsel for the appellant who may file the rejoinder four weeks thereafter.

Till the next date of hearing i.e. 07^th September, 2017 Notice under Section 8(4) of the Prevention of Money Laundering Act, 2002 shall remain stayed subject to the condition that, without prejudice, the appellant shall deposit Rs. 15,000/- per month towards use and occupation charges from the date of passing of the Impugned Order. We may clarify that the appellant shall file the affidavit disclosing the market rent on or before the next date. Liberty is also granted to the respondent to verify the rent and inform this Tribunal. The rent shall be deposited by the appellant within two weeks from today.
