A fresh appeal has been filed by appellant challenging the impugned order dated 31^st January, 2017 passed in O.C. No. 648/2016. Along with the appeal the appellant has filed two applications namely Condonation of Delay of nine days as well as Interim application. As far as the application for Condonation of Delay is concerned in view of the reasons explained in the application, we are inclined to condone the delay. As the prayer is not opposed on behalf of the respondent even it is small period of delay. The condonation of delay application is allowed. M.P. is disposed off.

As far as the application for stay is concerned the Learned Counsel for the Appellant although pressing for Interim Order, but admits that notice Under Section 8 (4) is not received. In case the respondent chooses to issue the notice Under Section 8 (4) of PMLA 2002, a copy of the notice be served to the counsel for the appellant who may press the interim order immediately. In the meanwhile, six weeks time is granted to the respondent to file the reply with an advance copy to the counsel for the appellant who may file the rejoinder within four weeks thereafter.
