Reply has not been filed despite of our direction issued on 7^th February, 2017, on the other hand the respondent has issued the noticed u/s 8(4) of PML Act for taking possession in respect of the two properties as i.e. Office no. 102 & 103, 1^st Floor, Animesh Complex, Opp. Union Bank of India, C.G. Road, Ellisbridge, Ahmedabad. The main arguing counsel on behalf of the respondent is not available. One final opportunity is granted to the respondent to file the reply within four weeks with an advance copy to the counsel for the appellant who may file the rejoinder within four weeks thereafter.

The appellant submits that the office no. 102 is being used by tenant and office no 103 is occupied by appellant for it’s own business. The appropriate final order in respect of notice u/s 8(4) would be passed on the next date of hearing. In the mean while the status quo shall be maintained by the respondent in respect of Office no. 102 & 103, 1^st Floor, Animesh Complex, Opp. Union Bank of India, C.G. Road, Ellisbridge, Ahmedabad. The appellant shall not dispose of or create third party interest in relation to both the properties.
