The counsel for the respondent states that the appeal filed by the appellant is not maintainable. The counsel for the appellant has pointed out the order dated 17^th July, 2015 passed by this Tribunal in appeal no. FPA-890/MUM/2015 in the matter of Shapoorji Pallonji & Co. Pvt. Ltd. V/s. The Deputy Director, Directorate of Enforcement, Mumbai as well as para no. 46 of the impugned order. The contention of both sides will be consider all at the time of hearing of the appeal. In the mean while, let the notice of the appeal be issued to the respondent. The counsel for the respondent accepts notice and seeks time to file the reply. The same may be filed within six weeks with an advance copy to the counsel for the appellant who may file rejoinder within four weeks thereafter.
