Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more in the nature of Writ of Mandamus declaring the action of the respondents in not according notional service benefits that would arise on implementation of integrated seniority list of Deputy Executive Engineers dated 29.9.2010 consequent to the disposal of the writ petition No.23807 of 2013 dated 12.6.2023 though the petitioner has brought to the notice of the respondents through his representations dated 29.7.2025 and 29.9.2025

The present Writ Petition is filed, under Article 226 of the Constitution of India, seeking the following relief:

“to issue any writ, order or direction more particularly one in the nature of Writ of Mandamus or an appropriate writ or order declaring the action of the respondents in not according notional service benefits that would arise on implementation of integrated seniority list of Deputy Executive Engineers dated 29.9.2010 consequent to the disposal of the writ petition No.23807 of 2013 dated 12.6.2023 though the petitioner has brought to the notice of the respondents through his representations dated 29.7.2025 and 29.9.2025 as illegal, arbitrary and violative of Article 14 and 16 of the Constitution of India and consequently declare that the petitioner is entitled for notional benefits of fixation of pay and allowances in the category of Deputy Executive Engineer and other benefits such as notional promotions and re-fixation of pension as per the rules and law and to pass….”

Heard Mr. Vadapalli Ramesh, learned counsel for the petitioner and learned Assistant Government Pleader appearing for respondents.

Initially the case of the petitioner was considered by the concerned authority as per the orders in O.A.No.11696 of 2009 and the same was disposed of extending notional seniority to the applicant after examining the case of the applicant as and when final seniority list has been prepared and further, the respondents shall take steps to prepare the seniority list as expeditiously as possible. Consequently, the petitioner has made representation to the respondents to consider his case for notional benefit on 29.7.2025 and 29.9.2025 and the same was not considered by the authorities. Hence the Writ Petition.

Learned Assistant Government Pleader submitted that the Court

may pass appropriate orders.

Considering the said submissions, the Writ Petition is disposed of directing the respondents to consider the representations made by the petitioner and pass appropriate orders basing on records. The said exercise shall be completed within a period of three (03) months from the date of receipt of a copy of this order. No costs.

As a sequel thereto, interlocutory applications pending, if any, in the writ petition, shall also stand closed.
