This Court made the following ORDER:

This Writ Petition is filed under Article 226 of the Constitution of

India by the Petitioners for the following relief:

“to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus, to declaring the action of the Respondent No.2 in issuing the surcharge orders vide proceedings in RC.No., 216/2022-B1 Dt 2801-2025, which is illegal, arbitrary and violation of Article 14 and 21 of the Constitution of India, and consequently set-aside the same….”

Heard the learned counsel for the petitioner and the learned Government Pleader for respondents.

The present writ petition is filed questioning the surcharge order dated 28.01.2025 issued by the 2nd respondent.

When the matter was taken up for hearing, the learned counsel appearing for the petitioner submitted that the petitioner may be permitted to avail the statutory remedy available under the relevant provisions of law against the impugned surcharge order.

In view of the said submission, this Court is not inclined to go into the merits of the case, particularly when an effective and efficacious statutory remedy is available to the petitioner.

Accordingly, the writ petition is disposed of granting liberty to the petitioner to avail the statutory remedy available under law against the impugned order dated 28.01.2025. If such statutory remedy is availed by the petitioner, the competent authority shall consider the same in accordance with law and pass appropriate orders, after affording an opportunity of hearing to the petitioner, within a reasonable period of time. There shall be no order as to costs.

As a sequel, interlocutory applications if any pending, shall stand closed.
