This Court made the following ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India by the Petitioners for the following relief:

“to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents herein in not granting the Special Promotion Post Scale -1A on completion of 12 years service as Junior Assistant and also consequential Special Promotion Post Scale-1 B and completion of 18 years service as Junior Assistant, under Automatic Advancement Scheme issued under G.O.Ms.No.96 Finance (Pay Commissioner-II) Dept. dated 20-5-2011 as highly illegal, arbitrary and also contrary to the G.O. Ms. No.96 dated 205-2011 and consequentially this Hon'ble Court may be pleased to declare that the petitioner is entitled for Special Promotion Post Scale -1A and completion of 12 years service as Junior Assistant and also consequential Special Promotion Post Scale- 1 B as per the seniority and eligibility in the cadre of Junior Assistant and may pass….”

Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents.

The case of the petitioner is that she was appointed as Junior Assistant on compassionate grounds vide Proceedings Rc.No.A7/2945/2006, dated 17.08.2006, and was posted at GVR Government College of Music and Dance, Vijayawada, where she joined service. Her services were thereafter regularized and probation declared w.e.f. 24.08.2008 vide Proceedings No.B/11/09, dated 08.04.2009 . The

petitioner passed the departmental tests conducted by the APPSC in November, 2009 and thereby became eligible for promotion to the post of Senior Assistant , but the respondents have not considered her case for promotion till date. She completed 12 years of service on 24.08.2018 and 18 years of service in the cadre of Junior Assistant without any promotion and continues to work as Junior Assistant. Under the Automatic Advancement Scheme issued in G.O.Ms.No.96, Finance (Pay Commissioner-II) Department, dated 20.05.2011, the petitioner is entitled to SPP Scale–1A on completion of 12 years of service and SPP Scale– 1B on completion of 18 years of service in the same cadre, with all consequential benefits from the respective dates of eligibility. Accordingly, the petitioner submitted a representation dated 25.04.2025 to the 2^nd respondent seeking sanction of SPP Scale–1A and SPP Scale–1B. Thereafter, the 2^nd respondent, vide Memo No.A2/347/2025, dated 23.10.2025 , directed the 3^rd respondent to furnish a report for taking further action for sanction of SPP Scale–1A and consequential SPP Scale–1B. However, till date, the 3^rd respondent has neither considered the matter nor submitted any report . Hence, the present writ petition.

Considering the same, this court is not inclined to go into the merits of the case, the writ petition is disposed of with a direction to the 3^rd respondent to furnish the information sought by the 2^nd respondent vide

correspondence dated 23.10.2025, within a period of one (01) month . Upon receipt of such information, the 2^nd respondent shall consider the

request made by the petitioner and pass appropriate orders in accordance with G.O.Ms.No.96, Finance (Pay Commissioner-II) Department, dated 20.05.2011, within a period of one (01) month from the date of receipt of a copy of this order. There shall be no order as to costs.

As a sequel, interlocutory applications if any pending, shall stand closed.
