Learned counsel for the petitioner submits that the petitioner was appointed as an Advisor to the one of the Departments of Women Children, Differently Abled and Senior Citizens vide G.O.Rt.No.138, Department for Women, Children, Differently Abled and Senior Citizens (PROG.I), dated 10.10.2022. In pursuance of the above G.O., the petitioner assumed charge as Advisor to Department on 18.11.2022 and since then she was discharging her duties. The Government fixed the pay and allowances/rank/protocol under “R” category mentioned in the G.O.Ms.No.36, of the General Administration (POL.A), Dept, dated 17.05.2022. As per the said G.O. the Advisors under Category-R are entitled to receive Rs.3,82,000/per month towards salary, Personal Staff, Vehicle allowance, accommodation and mobile phone with data connection. Further, the petitioner discharged her duties as advisor to

Government for 18 months and 17 days and therefore, the petitioner is entitled for an amount of Rs.70,55,333/-. But the respondent authorities released an amount of Rs.38,89,667/and an amount of Rs.31,65,666/- is payable to the petitioner by the respondent authorities. As the payment of the said amount has not been made by the respondents, the petitioner has approached this Court by way of this writ petition.

It is the contention of the petitioner that even though the respondents admitted that the petitioner is entitled for payment of Rs.19,69,800/- no payment is being made. The petitioner contends that such non-payment of money is clearly arbitrary and high-handed requiring the interference of this Court.

This Court, in various orders, including the judgment of a learned Single Judge of this Court dated 05.10.2021 in W.P.No.10038 of 2021 and batch had taken the view that such non-payment of dues is arbitrary and that such dues need to be cleared by the respondents at the earliest.

On the other hand, learned Government Pleader for WD & CW filed written instructions dated 25.02.2026 furnished by the 1^st respondent, wherein it is admitted that as per the bills submitted

by the petitioner, an amount of Rs.19,69,800/- has to be paid towards balance and final remuneration to the petitioner for the period from December, 2023 to May, 2024, after duly deducting Income Tax at 10% per month and Professional tax of an amount of Rs.200/- per month.

In view of the facts and circumstances submitted in the affidavit, and the directions of this Court in various cases and after hearing the submissions of learned counsels for the both parties and on perusal of written instructions and material on record, this Court is of the considered opinion that this Writ Petition can be disposed of with a direction to the 1^st Respondent to release the admitted amount of Rs.19,69,800/- to the petitioner at the earliest i.e., not later than three (03) months from the date of receipt of a copy of this order. There shall be no order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
