pleased topleased to issue any writ, order or Direction more particularly one in the nature of writ of Mandamus declaring the action of the Respondents in issuing impugned Tender Notification vide Rc.No.215/DCHS/GNT/2025 dated 15.08.2025 calling for tenders for supplying diets to the inpatients and duty doctors at Area Hospital, Narasaraopet, Palnadu District and accepting tender bids on 23.08.2025 even though the Petitioner is still under contract for supplying diets to the Area Hospital, Narasaraopet as illegal, arbitrary, unjust, in violation of Proceedings Rc.No.01/E1/2023 dated 23.01.2023 and against the Articles 14, 19, 21 and 300-A of the Constitution of India and consequently set aside the impugned Tender Notification vide Rc.No.215/DCHS/GNT/2025dated 15.08.2025 and direct the Respondents not to finalize the tender bids which were held on 23.08.2025 basing on the impugned Tender Notification vide Rc.No.215/DCHS/GNT/2025 dated 15.08.2025 and further direct the Respondents to extend the Petitioners contract period for another one year for supplying diets to the inpatients and duty doctors at Area Hospital, Narasaraopet, Palnadu District and pass

Heard learned counsel for the petitioner and learned counsel for the respondents.

The present writ petition is filed declaring the inaction of respondents in issuing impugned tender notification dated 15.08.2025 calling for tenders for supplying diets to the inpatients and duty doctors at Area Hospital, Narasaraopet, Palnadu District even though the petitioner is still under the contract for supplying diets to the said hospital as illegal and arbitrary.

Learned counsel for the petitioner submits that pending writ petition, the tender process was completed and the said contract was awarded to the successful bidder. He further submits that in view of finalization of tender, awarding of contract and entering into agreement with the successful bidder, the claim of the petitioner becomes infructuous. Therefore, in the present writ petition, no cause survives for further adjudication and the matter becomes infructuous.
