Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased toto issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, to declare the action of the 3rd respondent in issuing the Circular No.RU/Teaching.Estt/Circular/2017 dt. 185-2017, is illegal, arbitrary, unjust and unconstitutional and consequently set aside the Circular No.RU /Teaching. Estt/Circular 2017 dt. 18-5-2017 as far as the petitioner is concerned and issue consequential directions restraining the respondents from replacing the petitioner with any other Contract Assistant

Professor/Teaching Assistant in pursuance of the Circular No.RU/Teaching. Estt/Circular 2007 dt. 18-5-2017 with a further direction to the respondents to continue the petitioner as Contract Faculty in the Department of Botany till regularizing her services in the newly created posts in terms of G.O.Ms.no. 33 Higher Education (U.E.) Department dt. 30-6-2017, and to grant such other relief or reliefs as this Hon'ble Court deems fit and proper in the circumstances of the case.

The Court made the following ORDER:

This Writ Petition under Article 226 of the Constitution of India is filed for

the following relief:

“……..to declare the action of the 3rd respondent in issuing the Circular No.RU/Teaching.Estt/Circular/2017 dt. 18-5-2017, is illegal, arbitrary, unjust and unconstitutional and consequently set aside the Circular No.RU /Teaching. Estt/Circular 2017 dt. 18-5-2017 as far as the petitioner is concerned and issue consequential directions restraining the respondents from replacing the petitioner with any other Contract Assistant Professor/Teaching Assistant in pursuance of the Circular No.RU/Teaching. Estt/Circular 2007 dt. 18-5-2017 with a further direction to the respondents to continue the petitioner as Contract Faculty in the Department of Botany till regularizing her services in the newly created posts in terms of G.O.Ms.no. 33 Higher Education (U.E.) When the matter is taken up for hearing, Smt. N. Vijaya Santhi, learned Standing Counsel for the respondent University, while placing a copy of Office

Order in proceedings No.RUK/T.Estt./2023 dated 21.01.2023, submits that the

petitioner extended his services in the respondent University up to the age of 62 years on contract and subsequently, he had been retired from service on 31.01.2023 afternoon. The copy of the office order is forwarded to the learned counsel for the petitioner.

Sri K. Viswanadham, learned counsel representing the learned counsel for the petitioner, has not disputed the above submission made by the learned Standing Counsel and he also submits that the cause in the writ petition does not survive for further adjudication in view of the superannuation of the petitioner.

Recording the submissions made by both the counsel and in view of the fact that, due to efflux of time, the petitioner retired from service on 31.01.2023, the writ petition is closed.

There shall be no order as to costs. Miscellaneous petitions, if any, shall stand closed.
