Enquiry Officer and proceeding with the enquiry without supplying the documents asked for by the petitioner to enable him to submit his explanation to various charges framed and also without considering the objections raised as to the initiation of disciplinary proceedings in proper perspective as arbitrary, illegal and in violation of well settled principles of natural justice and to pass

The Court made the following ORDER:

The writ petition is filed seeking the following main prayer:

“…to issue an appropriate Writ or order or direction particularly one in the nature of Writ of Mandamus declaring the action of the 3rd respondent in initiating disciplinary proceedings and appointing the 4th respondent as Enquiry Officer and proceeding with the enquiry without supplying the documents asked for by the petitioner to enable him to submit his explanation to various charges framed and also without considering the objections raised as to the initiation of disciplinary proceedings in proper perspective as arbitrary, illegal and in violation of well settled principles of natural justice…”

Heard learned counsel for the petitioner and learned Assistant Government Pleader appearing for respondents.

The present writ petition is filed challenging the enquiry proceedings mainly on the ground that the petitioner was not provided with the relevant documents, thereby depriving him of an effective opportunity to represent his case in the enquiry proceedings.

Learned Assistant Government Pleader appearing for respondents submits that the enquiry proceedings leveled against the petitioner is completed and subsequently, the petitioner was also retired from service and received all his terminal benefits.

Learned counsel for petitioner conceded to the above submission of the learned Assistant Government Pleader.

Recording the above submissions, as cause does not survive, the writ

petition is disposed of. No costs.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
