Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of WRIT OF MANDAMUS declaring the inaction of Respondent Nos. 2, 3 and 4 in not exercising the statutory powers vested in them under the provisions of the Andhra Pradesh Allopathic Private Medical Care Establishments (Registration and Regulation) Act, 2002 by failing to conduct inspection and enquiry on complaints dated 13.01.2025 and 23.01 .2025 and the representations dated 07.03.2026 and 28.04.2026 submitted by the petitioner, as illegal, arbitrary, contrary to the object and purpose of the statute and violative of Articles 14 and 21 of the Constitution of India and consequently direct Respondent Nos. 2, 3 and 4 to conduct inspection and enquiry with respect to the establishments referred to in the aforesaid complaints 'and representation, verify compliance with the provisions of the APAPMC Act pass appropriate orders in accordance with law and take consequential action based upon the findings arrived at during such inspection and enquiry within a time frame fixed by this Hon'ble Court.

The Writ Petition is filed challenging the action of the respondents 2, 3 and 4 in not exercising the statutory powers vested in them under the provisions of the Andhra Pradesh Allopathic Private Medical Care Establishments (Registration and Regulation) Act, 2002 and failed to conduct inspection and enquiry on complaints dated 13.01.2025 and 23.01.2025 and the representations dated 07.03.2026 and 28.04.2026, which amounts to arbitrary, illegal and in violation of Articles 14 and 21 of the Constitution of India. Consequently, prayed to direct the respondents 2, 3 and 4 to conduct inspection and enquiry with respect to the establishments referred to in the aforesaid complaints and representations.

Learned counsel appearing for the respondents 1 and 5 produced instructions dated 04.07.2026 addressed by the 5^th respondent and that indicates that the respondents have issued notices and conducted enquiry as against the complaints and representations. It is further stated that once again they will conduct inspection as per the complaints and representations made by the petitioner.

Therefore, the respondent authorities have addressed the representations dated 07.03.2026 and 28.04.2026 and the complaints dated 13.01.2025 and 23.01.2025. As such, nothing survives in the present Writ Petition. However, the respondents are directed to make an endeavour to conduct periodical inspections against the nonregistered hospitals as noticed in the letter addressed vide R.C.No.Spl/APAPMCE/DMEMO/DM&HO/ATP/2026 dated 04.07.2026.
