Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ Order or direction particularly, one in the nature of writ of Mandamus declaring the action of the respondents in not registering FIR in accordance with procedure contemplated under section 173(4) BNSS is illegal, arbitrary and violation of principles of natural justice and also violations of Article 14,16,19 and 300-A of the Constitution of India and consequently direct the respondents to register the complaint duly considering the complaint of the 2nd petitioner made 13.04.2024, 11.09.2025 and 25.03.2026 and pass

ORDER:-

The instant writ petition has been filed by the petitioners under Article 226 of Constitution of India seeking the following main prayer:

“….to issue a Writ Order or direction particularly, one in the nature of writ of Mandamus declaring the action of the respondents in not regfstering FIR in accordance with procedure contemplated under section 173(4) BNSS is illegal, arbitrary and violation of principles of natural justice and also violations of Article 14,16,19 and 300-A of the Constitution of India and consequently direct the respondents to register the complaint duly considering the complaint of the 2nd petitioner made 13.04.2024, 11.09.2025 and 25.03.2026 and pass….”

Ms. N. Lalitha Sree, learned counsel for the petitioners, seeks permission of this Court to withdraw the instant writ petition with a liberty to work out the legal remedies available to the petitioners.

Accordingly, in view of the submission made by the learned counsel for the petitioners, the Writ Petition is dismissed as withdrawn leaving it open to the petitioners to work out their legal remedies, in accordance with law.

As a sequel, all pending applications shall stand closed.
