Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate writ, order or direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondent authorities in not releasing an amount of Rs.8,34,268 and Rs.6,17,572 to the petitioners for the execution of works, vide Agreement Nos. DR.No.07/2023- 2024 and DR. No. 10/2023-2024 dated 12.03.2024, respectively as arbitrary, illegal, contrary to Law and against the Principles of Natural Justice and against the Norms of the Public Policy and to issue consequential direction directing the respondent authorities to release the amounts payable to the petitioners with an interest at 18 percent per annum and to pass

Aggrieved by the non-payment of bill amounts to the petitioner in relation to the works executed vide Agreement Nos.DR.No.07/20232024 and DR.No.10/2023-2024 dated 12.03.2024, the present writ petition is filed.

Heard Sri G.Venkat Sailendra, learned counsel for the petitioner and Sri Shaik Abdul Rasheed, learned Assistant Government Pleader for Roads & Buildings.

Sri Shaik Abdul Rasheed, learned Assistant Government Pleader for Roads & Buildings on written instructions dated 14.06.2026 submitted that, the authorities have admitted to pay the entitled net amount to the petitioner and sought three months time for such payment.

To the said submission, learned counsel for the petitioner reported no objection, however, prayed to grant reasonable time as the amount is paltry.

¶36

Taking into consideration the submissions of both the learned counsel and as the authorities are ready to pay the admitted amount to the petitioner, this court is inclined to dispose of the writ petition , at the admission stage by passing the following order:

“The respondents are directed to release the legally admitted/entitled net amount to the petitioner at the earliest, and at any

rate, within a period of three (03) months from the date of receipt of copy of this order.”
