Assailing the proceedings issued by the 4^th respondent vide Rc.C/241/2025 dated 06.03.2026 (Ex.P1), the above writ petition was filed.

The petitioner was appointed as the Fair Price Shop Dealer in respect of F.P. Shop No.0811029 of Veligandla Village, Konakanamitla Mandal, Markapuram District. Acting upon the inspection report submitted by the Enforcement Deputy Tahsildar, dated 12.12.2025, a show cause notice vide Rc.E/1038/2025 dated 29.12.2025 (Ex.P2) was issued to the petitioner. The petitioner submitted an explanation dated 30.12.2025 (Ex.P3). Thereafter, by the impugned proceedings Ex.P1, the 4^th respondent suspended the authorisation of the petitioner pending inquiry.

Learned counsel for the petitioner would submit that, without considering the explanation and without furnishing the relevant documents, the petitioner’s authorisation was suspended. He would further submit that, as per Clause 8(4) of Andhra Pradesh State Targeted Public Distribution System (Control) Order, 2018, the inquiry must be completed within ninety days. However, the inquiry has not been completed so far. Thus, the learned counsel urged this Court to suspend the proceedings under Ex.P1.

Learned Assistant Government Pleader for Civil Supplies, on the other hand, would submit that, considering the variations and the explanation submitted by the petitioner, the authorisation of the petitioner was suspended pending inquiry. He would fairly submit that the inquiry ought to have been completed within ninety days. However, in the case at hand, the inquiry was not completed due to various reasons beyond the control of the authority. Learned Assistant Government Pleader urged this Court to grant four more weeks to complete the inquiry.

In reply, learned counsel for the petitioner did not refute the said submission.

Given the facts and circumstances of the case, keeping the writ petition pending and inviting a counter may not serve any purpose. Accordingly, the writ petition is disposed of, at the stage of admission, with the consent of both the learned counsel, with the following directions:

i) The 4^th respondent shall furnish a copy of the inspection report and other relevant documents to the petitioner, if not already furnished.

ii) The petitioner is at liberty to submit an explanation, if not already submitted.

iii) The 4^th respondent shall complete the inquiry, keeping in view the time prescribed under Clause-8(4) of the A.P.S.T.P.D.S (Control) Order, 2018.

iv) The 4^th respondent shall adhere to the circular instructions vide CCS.Ref.No.PDS.II(1)/307/2025 dated 05.12.2025 and the order in W.A.No.122 of 2025.

v) The petitioner shall cooperate during the inquiry.

vi) If the 4^th respondent fails to complete the inquiry within the stipulated time, as referred to supra , the proceedings Ex.P1 dated 06.03.2026 shall stand revoked automatically without any further reference to this Court.

vii) In such an event, the 4^th respondent shall restore the authorisation of the petitioner in respect of F.P. Shop No.0811029 of Veligandla Village, Konakanamitla Mandal, Markapuram District.

viii) There shall be no order as to costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
