Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased tomay pleased to issue an appropriate writ order or direction more particularly one in the nature of Writ of Mandamus, declaring action of the respondents in not releasing financial assistance of Rs. 10,00,000/-(Ten Lakhs only) to the son of the petitioner Polamarasetti Bhargav under application ID No. OV2019122541 despite sanction of funds by the Government as per G.O.Rt.No. 174 dated 07.12.2017 r/wG.O.Ms.No. 29 dated 27.08.2016 as illegal, arbitrary, unconstitutional, and consequently direct the respondents to release financial assistance of Rs. 10,00,000/- to the son of the petitioner Polamarasetti Bhargav under application ID No. OV2019122541 as per G.O.Rt. The present Writ Petition is filed questioning the action of Respondents in not releasing the financial assistance of Rs.10,00,000/- (Rupees Ten Lakhs only), sanctioned to Petitioner No.2 (Application I.D. No.OV2019122541) under ‘Videshi Vidya Deevana’ Overseas Scholarship scheme, as illegal and arbitrary.

The Petitioner No.2 had applied for financial assistance under ‘Videshi Vidya Deevana’ Overseas Scholarship scheme for the academic year 2010-2020 and the same was allotted with Application I.D. No. OV2019122541. After due verification, Respondent No.4 sanctioned Rs.10,00,000/- (Rupees Ten Lakhs only) in favour of the Petitioner for pursuing Post Graduation Course (Masters in Applied Science) at Jamescook University, Australia. The Respondenrts have to release first installment after the candidate arrived at overseas by uploading Immigration Card and the second installment has to be released after uploading the results of first semester. though, the 2^nd Petitioner uploaded the Immigration Card and result of first semester, the Respondents have not released the amount. Though, the Petitioner had completed his Post Graduation, the financial assistance as promised to the Petitioner was not disbursed to him. Hence, the present Writ Petition is filed.

Learned Standing Counsel for Respondent No.4/Corporation submits that the application of the 2^nd Petitioner would be considered and amounts would be sanctioned, if the Petitioner is within the conditions specified, for release of the amounts.

Considering the submissions, this Writ Petition is disposed of, with the following directions:-

(i) The Respondents are directed to examine the claim of the 2^nd Petitioner within a period of six (06) weeks from the date of receipt of a copy of this order.

(ii) In the event, the claim of the 2^nd Petitioner is held to be in order, the Respondents are directed to

release the amounts to the Petitioners within a

further period of eight (08) weeks.

(iii) There shall be no order as to costs.
