Despite service of notice on Respondent No.2, there is no representation on behalf of Respondent No.2.

Therefore, Smt. R.Durga Latha Sri, learned Counsel, is appointed as Legal Aid Counsel for Respondent No.2. The Secretary, High Court Legal Services Committee, is directed to issue necessary proceedings in this regard.

Heard the learned Counsel for the Petitioners, the learned Assistant Public Prosecutor, and the learned Legal Aid Counsel for Respondent No.2.

On the complaint lodged by Respondent No.2, the police registered a

case in Crime No.93 of 2024 of Kalyanadurgam Police Station for the alleged

offences punishable under Sections 341, 323, and 506 read with Section 34 of the Indian Penal Code, 1860 (for short, ‘the I.P.C.’). After completion of investigation, a charge sheet has been filed. The Investigating Officer examined as many as eight witnesses, and all of them have corroborated the version of L.W.1. The allegations as to whether the Petitioners assaulted and intimidated Respondent No.2 are matters to be adjudicated during trial upon appreciation of evidence adduced by the prosecution witnesses.

In view of the specific allegations levelled against the Petitioners and the overt acts attributed to them, this Court is of the opinion that the Calendar Case cannot be quashed by invoking the inherent powers under Section 482 of ‘the Cr.P.C.’ The Criminal Petition is devoid of merits.

However, considering the facts and circumstances of the case, the Criminal Petition is disposed of, with a direction that the presence of the Petitioners before the learned Trial Court shall stand dispensed with, unless their attendance is specifically required by the Court for any purpose.

As a sequel, interlocutory applications, if any pending, shall stand closed.
