THE HONOURABLE SRI JUSTICE RAVI NATH TILHARI THE HONOURABLE SRI JUSTICE BALAJI MEDAMALLI APPEAL SUIT NO: 302/2020

JUDGMENT:- (per Hon’ble Sri Justice Ravi Nath Tilhari)

The suit for partition i.e., O.S.No.14 of 2006 filed by the plaintiffs/appellants was dismissed. Challenging the same, the present Appeal Suit has been filed.

Sri Phani Teja Cheruvu, learned counsel for the appellants has submitted a letter dated 23.02.2026 to the Registrar (Judicial), Andhra Pradesh High Court, on record submitting as follows:

“ I submit that the above said A.S.No.302/2020 was filed against the judgment and decree in O.S.No.14/2006 dated 20.12.2018 on the file of Court of the II Additional District Judge’s Court at Madanapalle, Chittoor District. As the Appeal is filed regarding to the partition of the suit schedule property/s, the Trial Court dismissed the suit filed by the appellants/plaintiffs herein and during the pendency of this Appeal Suit, as per the Appellants instructions and covering letter addressing to the learned counsel for A.S.No.302/2020 withdrawal and the counsel on record filed a memo before the Registry for withdrawal with vide A.S.U.S.R.No.22625/2026 dated 20.02.2026 and the Appellant No.1 is the aged person and suffering with several old aged alignments and seeking for earlier disposal of the above said Appeal as withdrawal.

I therefore request you kindly direct the concerned posting section to post/list the A.S.No.302/2020 in the caption of withdrawal before the concerned bench in the interest of justice and pass other order or orders as deemed fit and proper in the circumstances of case.”

In view of the above, the Appeal Suit is dismissed as withdrawn.

No order as to costs.
