Venkata Kullai Reddy v. State of Andhra Pradesh and others. The petitioner, an agriculturist of K. Raghavapuram village, Muddanur Mandal, Y.S.R. Kadapa District, filed a writ petition under Article 226 seeking a mandamus declaring illegal the action of the Station House Officer, Muddanur Police Station (3rd respondent) in allegedly harassing him by repeatedly summoning him to the police station, objecting to his every act, and insisting that he settle a civil dispute pending as O.S. No. 175 of 2018 before the Junior Civil Judge, Jammalamadugu, together with the impugned action in Crime No. 22 of 2019, as violative of Articles 14 and 21 of the Constitution of India, and seeking a direction of non-interference with his liberty. Crime No. 22 of 2019 had been registered against the 4th respondent (S. Parameswara Reddy) on the petitioner's complaint before the learned Judicial Magistrate of First Class, Jammalamadugu. Sri R. Mallikarjuna Rao, learned Assistant Government Pleader for Home, on written instructions, submitted that the dispute was civil in nature, that after enquiry the police found it so and would not interfere in such matters, and that the writ petition was filed with false allegations. Without expressing any finding on the rival contentions, the Court closed the writ petition at the admission stage without going into the merits, made no order as to costs, and, as a sequel, all pending interlocutory applications (including I.A. No. 1 of 2019 under Section 151 CPC) stood closed. No precedent was cited or relied upon.
