...Respondents Petition under Article 226 of the Constitution of India is filed praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to Issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 3 rd respondent herein with regard to issuing tender Notification No.96 to 101/2014- 2015/D.No.590/15 dt.9.2.2015 in pursuant to which the works stated therein such as 1. 11 KV Minimuluru Feeder,^2. 11 KV Makavaram

feeder, 3. Pedaguda feeder, 4. 5 Nos. 11 KV feeders of Paderu SubDivision, 5.10 Nos. 11 KV feeders of Araku Sub-Division and 6. 7 Nos. 11 KV feeders of Chintapalli Sub-Division of Paderu Division^{from1.3.2015to} 28.2.2016 are tendered without following the fair procedure and transparency and to declare the aforesaid tender notice as illegal, arbitrary and in gross violative of rights guaranteed under Article 14, 19(1 )(g) and 299 of Constitution of India as held by the Hon'ble Apex Court in Ramana Dayaramsetty vs International Air Port Authority of India reported in 1979 (3) see 489 and consequently set-aside the same. Petition under Section 151 CPC is filed praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the 6*'^ respondent herein to grant stay of all further proceedings in pursuant to tender notification No.96 to 101/20142015/D.No.590/15 dt.9.2.2015 issued by the respondent herein or in alternative not to confirm and/or enter into agreement with 4'^ respondent for execution of works 1. 11 KV Minimuluru Feeder, 2. 11 KV Makavaram feeder, 3.
