“… . to issue a Writ Order or Orders or directions more particularly one in nature of Writ of Mandamus declaring the impugned proceedings issued by the respondents particular the 2^nd respondent vide Memo.No.2656707/HR/2024 dated 08.12.2021 in issuing the provisional selection list communicated by the APPSC towards recruitment Medical Officers AYUSH and issuing posting orders as illegal absurd unconditional contrary to the interim orders in WP.No.28170 of 2021 dated 08.12.2021 contrary to the orders in the Writ Appeal No.922 of 2024 dated 21.11.2024 staying only the observations at para 60(2) contrary to the common order passed in W.P.No.22958, 26282, 27338 and 27616 of 2021 dated 28.03.2024 and violative Articles 14, 16 and 21 of the Constitution of India and set aside the same and pass such other order or orders as this Hon’ble Court may deems fit just and proper in the circumstances of the case. ”

Heard Sri G. Tuhin Kumar, learned counsel for the petitioners, Sri G. Rama Chandra Rao, learned Standing Counsel appearing for the 3^rd respondent and learned Assistant Government Pleader for Service appearing for the official respondents.

On hearing, learned counsel for the petitioners submits that, contrary to the interim orders of this Court passed in W.P.No.28170 of 2021 dated 08.12.2021 and to the orders in W.A.No.922 of 2024 dated 21.11.2024, the 2^nd respondent in issuing a provisional selection list communicated by the APPSC towards recruitment of Medical Officers and issuing posting orders vide Memo No. 2656707/HR/2024, dated 08.12.2021, is illegal and arbitrary. Therefore, learned counsel for the petitioner requests this Court to pass appropriate orders.

On the other hand, learned Assistant Government Pleader for Services has furnished a copy of the written instructions of Deputy Director (Administration) AYUSH Department, Gollapudi, Vijayawada dated Nil and states that as per the interim order granted by this Court, the authorities have kept twenty one (21) posts of Medical Officers (Ayurveda) vacant pursuant to the Notification No.8 of 2021,

dated 24.09.2021 and are proceeding further for recruitment of remaining 67 posts.

Considering the submissions of both the learned counsel, and as the respondent authorities are not proceedings for recruitment process with respect to the twenty one (21) posts of Medical Officers (Ayurveda) pursuant to the Notification No.8 of 2021, dated 24.09.2021, there is no purpose in keeping the writ petition pending and the same is liable to closed.
