This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:

“to issue an appropriate writ, order or direction more particularly one in nature of Writ of Mandamus declaring the inaction of the respondents in considering the applications dated 28.10.2023 and 17.09.2024 of the petitioner for de-notifying the property to an extent of 0.97 cents in sy.no. 335 situated in pedaparimi village, Thullur mandal, Guntur District is illegal, arbitrary and contrary to the provisions of Registration Act and consequently direct the respondents to consider the applications dated 28.10.2023 and 17.09.2024 of the petitioner by de-notifying the property to an extent of 0.97 cents in sy.no. 335 situated in pedaparimi village, Thullur mandal, Guntur District from 22A (l)(a) of the Registration Act, 1908 and pass…”

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue appearing for the respondent Nos. 1 to 5.

The case of the petitioner is that the petitioner is the absolute owner and possessor of the subject land admeasuring an extent of Ac. 0.97 cents in sy.no. 335 situated in Pedaparimi village, Thullur mandal, Guntur District. The petitioner purchased the subject property from one Kondaveeti Tirupati Rao by way of registered sale deed vide document No.1064 of 1983 dated 26.04.1983 and the same has been registered in the office of the joint sub registrar Tadikonda. Since then, the petitioner has been in peaceful possession and enjoyment of the said property. While things stood thus, the petitioner came to

know that the subject property has been included in the prohibitory list under Section 22-A(1)(a) of the Registration Act, 1908.

The learned counsel for the petitioner also submits that the petitioner already submitted an applications dated 28.10.2023 and 17.09.2024 to the respondent authorities, seeking for deletion of the subject property from the list of prohibited properties under Section 22-A(1)(a) of the Registration Act, 1908. Even after receipt of the applications of the petitioner dated 28.10.2023 and 17.09.2024, the respondent authorities neither considered nor issued any other proceedings so far. Hence the writ petition.

On the other hand, the learned Assistant Government Pleader for Revenue appearing for the respondents submits that, the respondent authorities will consider the applications made by the petitioner dated 28.10.2023 and 17.09.2024 and pass appropriate orders in accordance with law within a reasonable time.

Having regard to the submissions made by the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue appearing for the respondents, and on perusal of the material available on record, this Court is of the considered view that the present writ petition can be disposed of by directing the respondent authorities to consider the applications/representations of the petitioner, dated 28.10.2023 and 17.09.2024, for deletion of the subject property from the prohibited list notified under Section 22-A(1)(a) of the Registration Act, 1908 as expeditiously as

possible, strictly in accordance with the law, preferably within a period of four (04) months from the date of receipt of this order. It is needless to mention that the respondent authorities shall conduct a necessary inquiry by hearing all the concerned parties.

With the above direction the writ petition is disposed of. No order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in the writ petition shall stand closed.
