The present Writ Petition is filed, under Article 226 of the Constitution of India, seeking the following relief:

“to issue any writ, order or direction more particularly one in the nature of Writ of Mandamus or an appropriate writ or order declaring the action of the Respondents in not cancelling pattas, pattadar passbooks, mutation entries and occupation certificates to various private individuals issued by the Revenue Authorities in respect of the land in Survey No.157 of Manchala Village, Mantralayam Mandal, Kurnool District, belonging to the Petitioner Mutt as illegal and consequently direct the Respondents to take action to evict the private individuals from the land of the Petitioner Mutt situated in Survey No.157 of Manchala Village, Mantralayam Mandal, Kurnool District and restore possession to the Petitioner Mutt and pass….”

Heard M/s. K.Sitaram, learned counsel for the petitioner and learned Assistant Government Pleader appearing for respondents.

The Writ Petition is filed praying the Court to declare the action of the respondents in not cancelling pattas, pattadar passbooks, mutation entries and occupation certificates to various private individuals issued by the revenue authorities in respect of land in Sy.No.157 of Manchala Village, Mantralayam Mandal, Kurnool District belonging to the petitioner Mutt as illegal, arbitrary and consequently direct the respondents to take action to evict the private individuals from the subject land and restore possession to the petitioner Mutt.

Learned Assistant Government Pleader submitted that the Court may pass appropriate orders.

Considering the submissions made by the petitioner and also on perusal of the record, this Court is not inclined to go into the merits of the case and notice to the proposed respondents is dispensed with and the official respondents are directed to conduct proper enquiry by issuing notice to all concerned and take appropriate decision. The said exercise shall be completed within a period of three (03) months from the date of receipt of a copy of the order.
