Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of Mandamus declaring the action of the respondents 2 and 5 in constructing the compound wall to 132 KV Sub Station, Ankireddypalem Village at Nallapadu Guntur, Guntur District by including petitioners land to an extent of Ac 0.50 cents in Sy No. 1204 of Ankireddypalem Village, Guntur Rural Mandal, Guntur District without issuing notice and without following due process of law as illegal, arbitrary and violative of Art 14, 21 and 300-A of Constitution of India and consequently direct the respondents 2 to 5 to pay compensation to petitioners by considering the petitioners representation dt 04.08.2025 and pass

The Writ Petition is filed to declare the action of Respondents 2 and 5 in constructing a compound wall to the 132 KV Sub-Station at Ankireddypalem Village, Nallapadu, Guntur District, by including the land of the Petitioner to the extent of Ac. 0.50 cents in Sy.No.1204 of Ankireddypalem Village, Guntur Rural Mandal, Guntur District, as illegal and arbitrary.

The contention of the Petitioner is that, though he was granted Patta long back before 1954, the Respondents, without following due process, are proceeding with the construction of a compound wall of the KV SubStation in that land. They have also included the land of the Petitioner to an extent of Ac. 0.50 cents.

In reply to the said contention, the learned Government Pleader for Revenue has submitted that the Patta for the subject land was resumed long back in 2007 itself and handed over to the Corporation for the construction of a Sub-Station, in an extent of Ac. 3.33 cents, in Survey No.1204 of Vengalayapalem, H/o. Ankireddypalem Village. Out of this, the Respondents have now constructed a Sub-Station in an extent of Ac. 3.21 cents.

Since there are certain issues with regard to the Patta granted in favour of the Petitioner, this Court is not inclined to go into the merits of the case.

Considering the submissions made by the learned counsel for the Petitioner, as well as the learned standing counsel appearing for Respondents 5 and 6 and the learned Government Pleader for Revenue, the Writ Petition is disposed of, directing the Respondents, more specifically, Respondents 2 to 4, to consider the Representation made by the Petitioner, dated 04.08.2025, and to pass appropriate orders based on the record and a field verification. No costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
