ORDER:

This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:

“…to issue any writ or direction more particularly one in the nature of Writ of Mandamus declaring the action of respondents 2 to 4 in summoning the petitioner to police station to obtain finger prints, photos and ID cards for the purpose of opening of suspect sheet as illegal and arbitrary and consequently direct the respondents not to take any steps to open suspect sheets against the petitioner holding that the said acts of the respondents are in violation of the fundamental rights guaranteed to me under Article 20 and 21 of the Constitution of India and pass.…”

Heard Sri K. Raja Reddy, learned counsel for the petitioner and Sri V. Farooq, learned Assistant Government Pleader for Home for the respondents.

Learned counsel for the petitioner would submit that the crime which is referred in the counter affidavit filed on behalf of respondent No.3 has been quashed by this Court. In the absence of any other case is pending against the petitioner, the petitioner cannot be called to the police station to obtain finger prints, photos and ID cards to open a suspect sheet. Learned counsel would further submit that a direction may be given to the police.

Learned Assistant Government Pleader for Home would submit the Court may pass an appropriate order.

Recording the above said submission, the Writ Petition is disposed of.

However, the police are directed not to call the petitioner to the police station since no crime has been pending against the petitioner. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
